Need Clarification on Open Notes Law and SP
AnsweredI am submitting this to clarify the SP response to the only other post regarding the new open notes law taking effect soon:
You are confirming for us that, since we do not need to be ONC certified, and are members of Simple Practice, we do not need to make our progress notes available to our clients this year? The open notes law does not apply to those of us running group practices?

The quickest way to get support for account-specific questions is to send us a help request by clicking the blue question mark > Get Help option on the lower right of your SimplePractice account. For everyone's reference, the 21st Century Cures Act only applies to ONC-certified EHRs, and SimplePractice is not currently ONC-certified. However, for additional guidance on how the Cures Act impacts your role as a clinician, we recommend reaching out to your local legal authority.
Whenever you would like to share notes with clients, you can export and share your data using our Data Export feature, and you can learn how to use our Data Export feature here: Data export: Exporting client information.
After you export your client data, navigate to your client's Overview page and follow these steps:
- Click Upload on the top right of their profile.
- Select the exported notes that you'd like to share with your client.
- Click Share on the top right of their profile.
- Select the uploaded file to share.
- Once you select the correct file, click Continue to Email to send it to your client. Your client will then be able to access their notes via the Client Portal.
