Medicare Opt Out Private Contract After the treatment?

I am fairly new to private practice.  I am treating a patient who agreed to pay privately because I am not taking medicare patients.  They agreed and paid.  They have since submitted a superbill to seek reimbursement.  I just discovered I should have an opt out contract with them.  Can we do this after the fact?  If not, what do I need to do next? Thank you.

  I am also needing some kind of Medicaid/medicare waiver form. I have a few clients who want to follow me to private practice from my previous employer because neither agency will accept their specific insurance.
