Divorced Parents needing to do Consent and ROI?

    I just had a conversation about this with our staff. First, it depends on the laws of the state you live in. Some states allow a minor as young as 14 to consent to outpatient mental health treatment without parental consent. And be careful with the ROI, as some state require the minors consent. We created a policy where, if the parents are divorced or legally separated, we require a copy of the most recent court-documented custodial arrangement to determine which parent(s) have custody. If both have custody, we require both parents to consent to treatment and sign ROIs. It's a pain, but we've had problems in the past with angry parents either not being involved in the treatment process or not approving of the treatment. We can't afford to hire lawyers if we get sued over this.
